KUALA LUMPUR, April 16 Datuk Seri Anwar Ibrahim insisted currently which the newly-proposed confidence law to replace the Internal Security Act (ISA) still contravenes tellurian rights, as well as demanded it be referred to the Parliamentary Select Committee (PSC) for review.
The antithesis leader, when debating the Security Offences (Special Measures) Bill in Parliament this morning, argued which the law right away transfers the energy to make capricious arrests to the judiciary instead of the executive arm of government.
He pointed out which whilst the controversial 52-year-old ISA grants absolute powers to the home minister to order the person's detention, the new confidence law offers the same energy to the courts.
"Now, all which is indispensable to be done is for the open prosecutor to merely indicate to the court which the particular be rearrested... what is the disproportion from the ISA?
"It is only which right away you have been using the court process to catch the person," Anwar(picture)said.
The Bill, tabled for first reading last week as the replacement to the ISA, stipulates which those under hearing for the confidence offence, once acquitted, upon application by the open prosecutor, can be remanded in prison tentative the notice of appeal against the court's decision.
In effect, this equates to the indicted will be kept imprisoned until all appeal avenues have been exhausted.
Anwar, who is also Pakatan Rakyat (PR) de facto leader, however commended the repeal of the ISA, saying which it has been the long-time onslaught of the opposition.
But he said which whilst Malaysia still needs laws to combat terrorism, the supervision should look into total reforms to the country's confidence hor! izon ins tead of merely enacting fresh laws.
"We do not want Malaysia to be the bottom for terrorist activities... you do want to have difficult measures against terrorism.
"Why not set up the counter-insurgency unit for the military force? Why is thirty per cent of the military force done up of the Special Branch unit which is more of the counter-Pakatan insurgency unit?
"The institutional horizon contingency be there... therefore, you have to oppose to the specific provisions in this Bill which is contrary to tellurian rights provisions," he told the press discussion later.
