Pencantasan Pendapat Berbeza

Dakwaan "takut mengelirukan" dan ugutan "jangan berani menentang hukum Allah" sering digunakan bagi mencantas pendapat yang berbeza.

Suatu masa dulu, Malaysia mengiktiraf penggunaan keempat-empat mazhab ahli sunnah wa jamaah iaitu Hanbali, Maliki, Shafie dan Hanafi. Namun sekarang telah di! sempitka n dengan mengangkat pendapat mazhab Shafie secara lebih eksklusif. Mazhab lain dianggap kurang penting. Akibatnya, ramai rakyat Malaysia bukan saja memandang serong pada Syiah, malah menjadi kurang yakin pada kebenaran pendapat ketiga-tiga mazhab ahli sunnah wa jamaah yang lain. Padahal, Imam Malik, Hanbali dan Hanafi semuanya ulama besar.

Tindakan mencantas apa saja pendapat yang berbeza telah menjadi suatu budaya di Malaysia. Sering benar ada gesaan untuk haramkan dan tapiskan apa-apa saja yang mereka anggap bertentangan dengan Islam.

Oleh kerana PAS dan pertubuhan-pertubuhan Islam tidak punya kuasa dalam pentadbiran kerajaan, maka mereka hanya boleh sekadar berdemo untuk mendesak pengharaman. Pihak-pihak yang mempunyai kuasa seperti JAKIM dan Majlis Fatwa boleh terus menguatkuasakannya. Selain dari konsert dan kumpulan yang dianggap sesat, yang sering menjadi mangsa pengharaman ialah buku-buku yang mereka tidak sukai. Buku "Fiqh Perempuan" tulisan seorang ulama lulusan Al-Azhar Mesir, Kiyai Husein Muhammad, yang banyak dijual dan dibaca di seluruh Indonesia, diharamkan di Malaysia. Begitulah, apa sahaja yang tidak disukai atau tidak difahami oleh agamawan di Malaysia, mudah sekali dilabel liberal, sesat atau bertentangan dengan Islam, lalu terus diharamkan.

Mursyidu! l Am PAS Datuk Nik Abdul Aziz Nik Mat pernah mencemuh Mufti Perak Tan Sri Harussani Zakaria "seorang mufti yang menjadi ejen parti politik sekular, itu bukanlah lagi al-mufti (yang memberikan fatwa) tetapi al-mufta (yang diberikan fatwa)". Bekas mufti Perlis Dr Mohd Asri pula telah dihalang dari memberi ceramah di Selangor. Ustaz Datuk Dr Badrulamin Bahron pemimpin PKR itu malah menggelar Asri sebagai "Mufti Gila" dan "Bapak Setan" serta mengugut "kalau boleh, saya nak pancung saja kepalanya".

Identiti fatwa semakin terselak dan ketara. Wajah-wajah manusia dengan segala keterbatasan ilmu dan kepentingannya tersendiri semakin terjelma di wajah fatwa.

Masyarakat semakin faham. Rupanya fatwa bukan sesuatu yang suci. Fatwa bukan firman Allah dan bukan hadith Nabi. Fatwa itu sekadar pendapat seseorang atau sekelompok manusia biasa, yang membesar di kalangan masyarakat dan lingkungan budayanya, telah belajar ilmu agama dan kemudiannya diangkat menjadi tokoh agama yang digelar ulama.

Pembebasan dari Kediktatoran dan Autokrasi

Konflik antara para agamawan di Malaysia telah menunjukkan betapa bahayanya bila agamawan diberi kuasa mutlak dalam menentukan atau menfatwakan sesuatu.

Pengharaman demonstrasi dan juga tindakan menjadikan fatwa kebal dari sebarang kritikan, kedua-duanya adalah tindakan yang bertentangan dengan demokrasi.

Pengharaman poco-poco, turut meraikan hari p erayaan agama lain, larangan memakai tumit tinggi dan gincu, saranan agar wanita cantik tidak diambil kerja ialah antara "fatwa" yang menjadikan orang tertawa.

Rakyat harus memastikan bahawa dalam negara demokrasi seperti Malaysia, agama tidak harus disalahgunakan untuk menyekat hak kebebasan untuk berfikir, mendapatkan pelbagai jenis ilmu dan hak menyuarakan pendapat mesti sentiasa terjamin.

Bila pihak berkuasa, para agamawan dan masyarakat Islam menyeru "kita harus kembali kepada ajaran Islam", soalan dasar yang harus dipertanyakan ialah "ajaran Islam" yang mana? Siapa yang boleh membuktikan yang hanya dia atau organisasinya saja yang telah mendapat mandat dan telah dilantik menjadi wakil Tuhan di Malaysia?

Aku belum tau apakah Islam itu sebenarnya.

Islam menurut Imam Hanbali, Malik, Syafie dan Hanafi,

Islam menurut Rabiah Al Adawiyah dan Ibn Rushd

Islam menurut Syed Qutb dan Muhammad Assad,

Islam menurut Iran, Arab Saudi dan Malaysia,

Islam menurut UMNO, PAS dan PKR
