Kisah hudud II: Di antara syariat Islam dan hukum hudud
Ini adalah perspektif kedua mengenai hukum hudud yang saya mahu berkongsi dengan pembaca. Ia ditulis oleh Ustaz Abdul Halim Abdullah, Ketua Biro Dakwah, Ikatan Muslimin Malaysia ISMA (isma.com).

Semasa saya belajar di University of Queensland 1984-1987 dulu, apabila pokok Jacaranda yang meranting kering di musim sejuk mula berbunga lebat berwarna ungu hampir di setiap jalan di universiti, di sebalik kecantikannya, jiwa para mahasiswa/i mula gundah gulana kerana ia menandakan peperiksaan hampir tiba.
Begitu juga di Malaysia, di setiap penghujung empat tahun lalu apabila isu hukum hudud mula dilemparkan melalui media massa ke tengah-tengah para pengundi, ia menandakan musim Pilihan Raya Umum Malaysia hampir tiba, hanya menunggu bila tarikhnya ditetapkan, bergantung respons para pengundi di bandar dan kampung, tua dan muda, kafir dan Islam.
Bagi golongan masyarakat yang faham dan beriman, mereka melihat dan menilai isu ini dengan pandangan Syarak dan pertimbangan realiti.
Namun mereka adalah hanya segelintir dari masyarakat umum yang jauh lebih ramai dan tersebar di seluruh negara.
Ada joke pada umum masyarakat, mereka kebingungan kerana sekali lagi isu ini diketengahkan dalam keadaan ilmu dan jiwa mereka yang tidak mampu memahaminya, dan ramai dari kalangan mereka yang akhirnya membuat pertimbangan dari neraca yang tidak Islamik lalu mengambil pendirian yang tidak tepat.
Syariat Islam dan hukuman Hudud mempunyai perbezaan yang sangat jauh. Syariat Islam adalah satu sistem hidup rabbani, keseluruhannya berasaskan al-Quran, kitab Allah dan petunjuk peninggalan dari Sunnah Rasul-Nya, Muhammad SAW, bermula dari membina ilmu dan akidah, melahirkan ibadah dan akhlak pada diri dan masyarakat dalam sesebuah negara, kemudian mereka meluaskan dakwah Islam ke negara-negara jiran sehingga Islam memimpin dan membimbing seluruh dunia, tanpa meningga! lkan sei nci joke bumi yang tidak diperintah oleh Syariat Islam.
Dengan ini Syariat Islam sifatnya membangunkan manusia dan dunia, lahir dan batin, manakala hukum menghukum seperti hudud, takzir dan seumpamanya boleh kita nisbahkan sebagai hanya 5 peratus sahaja dari Syariat Islam yang sifat umumnya adalah membangun.
Sebab itu al-Quran yang mempunyai lebih 6,000 ayat hanya mempunyai sekitar 500 ayat sahaja mengenai hukum hakam atau dipanggil "Ayat-ayat Ahkam".
Dari sekitar 500 ayat-ayat ahkam, hanya sebahagian kecil sahaja yang menyentuh hukum hudud dan selainnya menggarap isu-isu ekonomi, muamalat, munakahat, hubungan antarabangsa dan sebagainya. Adapun hukuman yang digelar "Hudud", ia adalah tujuh hukuman yang telah ditentukan Allah dalam al-Quran dan As-Sunnah.
Bagi mereka yang suka penerangan dengan angka, saya gambarkan di sini (sekadar mengemukakan angka yang tidak semestinya tepat, tetapi boleh memberi kefahaman yang lebih jelas), hukuman Hudud yang tujuh itu adalah seperti sekitar 5 peratus dari undang-undang Islam yang 95 peratus lagi adalah Takzir (denda) yang diserahkan kepada Dewan Rakyat di Parlimen menggubalnya dan hakim di kamar mahkamah menentukannya.
Oleh kerana 7 hukuman tersebut (1. bunuh, 2. zina, 3. menuduh zina/qazaf, 4. curi, 5. minum arak, 6. samun/qat" tariq, 7. bughoh menentang pemerintah dengan kekerasan) telah ditentukan Allah, dan tidak boleh diolah lagi oleh Parlimen atau hakim, maka ia disebut Hudud, di dalam bahasa Inggeris bermakna "already defined".
Kalau begitu, hukuman dan denda (termasuk Hudud) hanyalah 5 peratus daripada ajaran Islam yang bersifat membina umat dan negara, bukan meruntuh dan menghukum, manakala hukuman Hudud hanya 5 peratus daripada undang-undang Islam dalam sesebuah negara yang lengkap dan membangun, maka dari segi matematiknya hudud hanya 5 peratus x 5 peratus = 0.25 peratus daripada keseluruhan ajaran dan Syariat Islam sebenarnya.
Ia bukan segala-galanya mahupun juzuk besar daripada ajaran Islam yang sangat ! luas, me mbangun dan membahagiakan umat manusia.
Begitu juga yang kita maksudkan dengan rumah tangga Islam adalah ibu bapa yang berkeperibadian Islam, mendidik anak-anak dengan ajaran Islam, menjaga adab-adab Islam dalam rumah, suami isteri yang saling menghormati perjuangan Islam masing-masing, berdakwah kepada jiran-jiran, dan sebagainya, bukan semata-mata si ayah merotan anak (hukuman).
Begitu juga apabila kita maksudkan dengan sebuah Negara Islam, ia adalah negara yanag tertegaknya Syariat Islam dalam setiap bidang kehidupan rakyatnya, dan bukan semata-mata melaksanakan hukuman Hudud dan cuai pelbagai aspek Syariat Islam yang lain.
Ringkasnya, apa yang rakyat Islam di Malaysia mahu adalah penegakan Syariat Islam dalam semua bidang media massa terutamanya di siaran televisyen, pendidikan, pengurusan negara, kementerian dan jabatan, membebaskan rakyat daripada belenggu budaya Barat, membina umat yang berjihad dan punya kekuatan di rantau, menguatkan kesatuan umat dan membanteras perpecahan, menguatkan hubungan di antara negara-negara Islam, menyebarkan roh Islam ke dalam jabatan dan sektor kerajaan dan swasta, membanteras rasuah, membanteras pelacuran, arak, judi, dadah, kelucahan, pergaulan bebas, bidah, khurafat, syirik, mendorong hafazan al-Quran dan bahasa Arab terutama kepada generasi baru dengan berbagai insentif, kesihatan, ekonomi, akhlak, berjimat dengan wang rakyat dan menyuburkannya, meneroka kekayaan dan hasil bagi negara dan mengelakkan pemborosan dan pelaksanaan undang-undang Islam termasuk Hudud.
Oleh kerana itu kita adalah rakyat yang lebih bijak dari terheret membincangkan isu hudud menjelang pilihan raya, sedang selama tempoh tenang 4-5 tahun di antara dua musim pilihan raya, media massa merosakkan umat dengan memaparkan budaya Barat yang negatif kepada anak bangsa kita, pelacuran, arak, judi, kelucahan, rasuah tersebar ke tahap yang sukar dibendung dan telah menghakis banyak tunggak-tunggak negara terutamanya akhlak dan jiwa rakyat serta wang dan kekayaan negara.
Se mangat roh jihad di kalangan belia dan bebas dari pengaruh dominasi Kuasa Barat merupakan tunggak penting yang masih di dalam keadaan yang minimum.
Apa yang kita tuntut adalah Malaysia menjadi sebuah Negara Islam yang didefinisikan oleh Imam Hasan Al-Banna yang bermaksud "tidak akan tertegak Ad-Daulah Al-Islamiyah (Negara Islam) melainkan di atas asas Dakwah, sehingga ia menjadi Negara Risalah (negara yang mempunyai visi dan misi menyebarkan Islam ke seluruh dunia), bukan (semata-mata) ia berbentuk pentadbiran, atau kerajaan material beku pekak yang tidak mempunyai roh.
Seperti mana juga dakwah tidak (dapat) tertegak melainkan dalam satu perlindungan (iaitu negara) yang menjaga, menyebar, menyampai dan menguatkan Dakwah tersebut)". Satu persoalan yang sering dibicara oleh golongan terpelajar.
Dewan Undangan Negeri (DUN) dan Kerajaan Negeri mempunyai kuasa kebanyakannya dalam hal ehwal tanah, adat resam dan hal ehwal agama Islam manakala Parlimen dan Kerajaan Pusat mempunyai kuasa dalam bidang jenayah berat lebih-lebih lagi yang membabitkan hukuman mati.
Malah dikatakan sebarang penggubalan hukuman jenayah berat di DUN seperti hudud yang bertentangan dengan Parlimen, maka ia terbatal dengan sendirinya dan tidak boleh dilaksanakan oleh pihak negeri.
Wacana ilmiah mengenainya perlu dianjurkan lebih meluas untuk memberi pengetahuan dan kesedaran kepada umat.
Mereka yang benar-benar ikhlas bercakap mengenai hudud yang belum terjadi, seharusnya menegakkan Syariat Islam dalam bidang-bidang yang disebutkan di atas dalam masa yang sama yang sepatutnya telah lama terjadi dan mudah untuk dilaksanakan.
Adapun berbicara mengenai Hudud yang berkait dengan penggubalan dan sebagainya, tetapi membiarkan banyak perkara yang bertentangan dengan Syariat Islam di dalam pentadbiran dalam negara dan penghayatan dalam masyarakat adalah sebenarnya merupakan permainan kata-kata untuk mengeliru dan meraih sesuatu daripada masyarakat awam yang kurang mengerti apa yang sebenarnya seda! ng dan a kan berlaku.
