Nazri: Anti-hopping law would breach constitution


The supervision has stated which any law to demarcate inaugurated member from hopping from one party to another would go opposite Article 10 of the sovereign constitution which protects freedom of association.

karpal singh pc 200812 02In the written reply to DAP's Bukit Gelugor MP Karpal Singh(right), it pronounced people should be free to stick on or leave any party "without having to vacate their seats" as the penalty.

Karpal had asked the prime minister if the supervision would support Pakatan Rakyat MPs in proposing the shift to the sovereign constitution to move in an 'anti-hopping law'.

However, the reply from Mohd Nazri Abdul Aziz, Minister in the Prime Minister's Department, sidestepped the question.

He pronounced which any legislative addition to the constitution "is an issue of policy which needs to be studied as the whole, next to alternative associated laws".

Existing laws do not empower the Election Commission (EC) to establish penalties opposite inaugurated member who shift parties, he said.

The sovereign and respective state constitutions, as well as the Elections Act 1958, only authorise the EC to establish either or not the seat is vacant after reception notice from the orator of Parliament or the state assembly.

The DAP-led Penang supervision had last month voiced which it intends to list the Bill at the Nov sitting, to prevent state assemblypersons from defecting mid-term.
