NCR NOT REPEALED BY THE LAND ORDINANCE 1930

By : SENATOR DATUK MAIJOL MAHAP

"THE NCR law in Sabah is still subsisting until today. It was not repealed by a Land Ordinance 1930. The supplies underneath sections 13-16 of a existent Sabah Land Ordinance clearly show which NCR laws are still very much alive in Sabah. No physique should ever try to deny, nullify or rectify those local rights.

Therefore claim for NCR contingency be treated as NCR claim underneath those supplies and not underneath a normal duplicate for land as settled by a Director of Land Survey Deptartment. After all, as i know a Dept has been receiving NCR claims before and has approved them underneath those provisions. There is no reason why they can't continue you do it.
Those supplies were put in by a legislators when Sabah was governed by a British since essentially local customary law together with NCR predate any law, and if a govt wants to outlaw it now, there contingency be a transparent and accord action by a local legislators to do it. The Rambilin box is very transparent on this.

But i dont think any local authority will want to do it. The Director cant rectify a law unilaterally. I hope what a Director pronounced doesnt simulate a stance of a govt since if it does afterwards it will besad day for a natives in Sabah. The natives do not want their rights both piece and procession to be eroded or compromised. "
